This document, the Issue Box Terms of Service (the "TOS"), governs our relationship with users and others who interact with the Issue Box, and illustrates how to use the Issue Box. By using or accessing the Issue Box, you agree to the TOS, as updated.

I. What the Issue Box Is and How It Works

The Issue Box is a website, located at http://theissuebox.com, where users can create and vote on their own issues, and vote on the issues that other users have created. Let us show you what we mean. Here is what we are calling an issue: The United States should implement a program of free day-care.

Global warming is greatly exaggerated and stands in the way of valuable petroleum exploration and development.

You can create any issue you want, and you can adopt any issue that another user has created. The purpose of this site is to allow people to freely shape their own political platform, rather than have someone else shape it for them.



II. Restrictions on Content

This is a website for the posting of public speech, and about public topics. But that does not mean that every form of speech that is covered by the First Amendment is acceptable here at the Issue Box.

No hate speech.
No pornography, vulgarity, profanity, or obscenity.
No inciting of violence. No harassment of anyone, whether users or not.
No advertisements, commercials, URL addresses, or links to websites. If you have a legitimate, non-commercial reason for mentioning a website, kindly make all efforts to avoid using the URL.
No issues that deal with a private person or private issue. Issues must deal with something public.

Issues must be in the form of a statement, and in a complete sentence. This is not because we are militant grammarians. This is because every issue must be capable of being agreed with or disagreed with. That is the whole purpose of this site.

Issues must be in English. This is only because at the moment our moderators know only English.

III. Privacy

Your privacy is very important to us, so important that the we do not even allow the posting of personal information on the Issue Box. There is no capability of posting images or video, and we even do not allow you to use your own name. There are no privacy settings to set because we have already gone to the trouble of making your account completely untraceable to you to the observer, whether user or non-user.

When someone registers for the Issue Box and creates a new account, we assign that user a unique name that consists of three words: a generic adjective, noun, and verb. If you want to tell people what your three-word user name is, that's your business. But you can't do it here.

ll you do have to provide is an email address to register, we use this only to prevent users from creating more than one account and so that we can confirm that you are a human being. But we will not sell or otherwise share that email address with anyone, for any reason, unless compelled by valid court order acting within its jurisdiction.

IV. One Account Per User

The Issue Box is a website for humans. Bots are not allowed. We welcome all humans, of all ages, from all corners of the universe. But we allow only one account per human. This is keeping in line with the one vote per person policy that operates (we hope) in real elections. It is important that positions on issues not be artificially inflated.

One human being, one account. Violation of this policy may result in permanent ban from the Issue Box.


V. Ownership of Content

The Issue Box is anonymous. Thus, we cannot grant, recognize, or reserve to any users of the site any intellectual property (“IP”) rights in any of the content posted, whether the user has created that content or not. Users are prohibited from posting content to the Issue Box that is subject to any IP rights, either the users’ own, or the IP rights of others. In the event that users do post content to the Issue Box that contains IP rights, said users thereby effect a complete transfer to the Issue Box of all of said users’ IP rights in such content. To the extent that any content on the Issue Box is subject to the IP rights of others, the user who submitted the content grants all such IP rights to us. If the Issue Box or any of its principals are subjected to claims legal or equitable for infringement of IP rights, the user who posted the allegedly infringing content hereby agrees to defend, indemnify, and hold harmless the Issue Box against all claims, judgments, and liabilities.


VI. Safety

The Issue Box is designed to be, by its very nature, a very safe website to use. Everyone appears under a pseudonym that we create. There is no capability to post images or video or audio files. Posting of personal information - either about yourself or someone else - is strictly prohibited and will be removed with consequences to the poster. Your assigned name, your public issues, and your voting on those issues - that's it.

But to make the Issue Box work in the way we designed it still requires the following commitments by you:

1. You will not post advertisements or other commercial communications (such as spam).
2. You will not collect users' content or information, or otherwise access the Issue Box, using automated means (such as harvesting bots, robots, spiders, or scrapers).
3. You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on the Issue Box.
4. You will not upload viruses or other malicious code.
5. You will not solicit login information or access an account belonging to someone else.
6. You will not bully, intimidate, or harass any user.
7. You will not post content that: is hate speech, threatening, or pornographic; or incites violence; or references a non-public figure.
8. You will not promote or publicize or offer any contest, giveaway, or sweepstakes.
9. You will not use the Issue Box to do anything unlawful, misleading, malicious, or discriminatory.
10. You will not do anything that could disable, overburden, or impair the proper working or appearance of the Issue Box, such as a denial of service attack or interference with page rendering or other Issue Box functionality.
11. You will not facilitate or encourage any violations of this TOS.

VII. Registration

For the one human being, one vote principle set forth above, we have the following rules concerning registration:

1. You will not provide any false personal information on the Issue Box, or create an account for anyone other than yourself without permission.
2. You will not create more than one personal account.
3. If we disable your account, you will not create another one without our permission.
4. You will keep your contact information accurate and up-to-date.
5. You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.
6. You will not transfer your account to anyone without first getting our written permission.

VIII. Protecting Other People's Rights

We respect other people's rights, and expect you to do the same.

1. You will not post content or take any action on Issue Box that infringes or violates someone else's rights or otherwise violates the law.
2. We can remove any content or information you post on Issue Box if we believe that it violates this TOS.
3. If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
4. If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.
5. You will not use our copyrights or trademarks (including Issue Box, the Issue Box and TIB Logos), or any confusingly similar marks, except as expressly permitted by our Brand Usage Guidelines or with our prior written permission.
6. If you collect information from users, you will: obtain their consent, make it clear you (and not Issue Box) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.
7. You will not post anyone's identification documents or sensitive financial information on Issue Box.
8. You will not modify, create derivative works of, decompile, or otherwise attempt to extract source code from us, unless you are expressly permitted to do so under an open source license, or we give you express written permission.

IX. Amendments

1. This TOS may be amended at any time with or without notice.
2. Your continued use of Issue Box following changes to our terms constitutes your acceptance of our amended terms.

X. Termination

If you violate the letter or spirit of the TOS, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of Issue Box to you.
If you wish to delete your own account, please notify us using the Contact page. Deletion of account, or of any of the issues associated with that account, is not guaranteed.

XI. Disputes

1. You will resolve any claim, cause of action or dispute (claim) you have with us arising out of or relating to the TOS or Issue Box exclusively in the U.S. District Court for the Northern District of New York or a state court located in Saratoga County in the State of New York, and you agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims. The laws of the State of New York will govern the TOS, as well as any claim that might arise between you and us, without regard to conflict of law provisions.

2. If anyone brings a claim against us related to your actions, content or information on the Issue Box, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users' actions on the Issue Box and are not responsible for the content or information users transmit or share on the Issue Box. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may encounter on the Issue Box. We are not responsible for the conduct, whether online or offline, or any user of the Issue Box.

3. WE TRY TO KEEP THE ISSUE BOX UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING THE ISSUE BOX AS IS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE ISSUE BOX WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT THE ISSUE BOX WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. THE ISSUE BOX IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS STATEMENT OR THE ISSUE BOX, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, THE ISSUE BOX'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.


XII. Special Provisions Applicable to Users Outside the United States

We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. The following provisions apply to users and non-users who interact with the Issue Box outside the United States:

1. You consent to having your personal data transferred to and processed in the United States.
2. If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department's list of Specially Designated Nationals you will not engage in commercial activities on Issue Box (such as advertising or payments) or operate a Platform application or website. You will not use Issue Box if you are prohibited from receiving products, services, or software originating from the United States.

XIII. Definitions

1. "Issue Box": the features and services we make available, including through our website at www.theissuebox.com.
2. "content": anything you or other users post on the Issue Box.
3. "post": submitting an issue to the Issue Box using the Create an Issue tab.
4. "user": someone who has registered an account with us.


XIV. Other

1. The TOS is an agreement between you and the Issue Box.
2. The TOS makes up the entire agreement between the parties regarding Issue Box, and supersedes any prior agreements.
3. If any portion of the TOS is found to be unenforceable, the remaining portion will remain in full force and effect.
4. If we fail to enforce any of the TOS, it will not be considered a waiver.
5. Any amendment to or waiver of the TOS must be made in writing and signed by us.
6. You will not transfer any of your rights or obligations under the TOS to anyone else without our consent.
7. All of our rights and obligations under the TOS are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
8. Nothing in the TOS shall prevent us from complying with the law.
9. The TOS does not confer any third party beneficiary rights.
10. We reserve all rights not expressly granted to you.
11. You will comply with all applicable laws when using or accessing the Issue Box.
